All charter flights arranged through Dunamis Aviation are operated by independent, FAA-certificated Part 135 air carriers. Dunamis Aviation does not operate aircraft, employ pilots, or hold an FAA Air Carrier Certificate. The air carrier operating any charter flight maintains full and exclusive operational control of the aircraft, including all decisions related to crew, maintenance, flight routing, and airworthiness.

If the dispute cannot be resolved informally, you agree that any controversy or claim arising out of or relating to these Terms, or the breach thereof, shall be settled by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted in Tampa, Hillsborough County, Florida.

The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. Each party shall bear its own costs of arbitration, unless the arbitrator determines otherwise.

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration against Dunamis Aviation.
